The question should be to Anderson Law:  Why don't you support action against tribes that violate the civil rights of its members, or any other citizen for that matter?

Here is the text from Cantor's version:


‘(f) ACTION FOR REDRESS OF VIOLATION OF
22 RIGHTS.—Every person who, under color of any statute,

"Applying the precedents that permit suits against government officials in their official capacities, we conclude that this suit may proceed against the Principal Chief in his official capacity, without the Cherokee Nation itself as a party," Judge Brett Michael Kavanaugh wrote in the unanimous ruling.

Pechanga has disenrolled members from the tribe so they could get more money from the casino. pechanga even hired an expert Dr John Johnson to determan if they met the standerds to be members. his findings were yes. know these family that are direct desendents of a origenal allottee and live on that allottment are being illegaly violated again. let the disinrolled alottees have a say in this prosses

Those who have been disenrolled and denied membership include many allottees that would be adversely affected by the Acts as they provide that the very officials who have stripped or denied the allottees of rights set forth in tribal and federal law shall be responsible for satisfying the very same allottees’ entitlement to water.

Additionally, the Acts fails to provide adequate protections for allottees against future abuses by Pechanga tribal officials in the settlement and allocation of their rights under the Acts. Stronger safeguards and greater penalties are needed to deter tribal officials from once again taking or denying ownership rights vested in allottees and others who may have rights under the settlement agreement and the Acts.

You as representatives MUST make yourselves aware of what is going on in Indian Country. Sovereign nations like Pechanga, which treat their people badly, should be treated like, say, South Africa. They have the sovereign right to abuse their people, to strip them of voting rights, tribal health care, educational assistance and per capita. They have the right to engorge themselves on the stolen per capita.

YOU as representative have the right an obligation NOT to reward said tribes with: Land into trust and total control over water rights.

YOU have an obligation to stand up for the abused,NOT the abusers.

Elected representatives, please know that as of 2006 Pechanga disenrolled an extended family from the tribal rolls. This family has many members who still live on the Pechanga reservation on allotted land. This bill needs to address these Indians who no longer hold membership status, but hold rights to these allotted lands.

As of today this family has no say in tribal communications, voting rights, land uses and lives under constant fear that this current council will continue to deny these Indians rights. Pechanga has no legal forum for this extended family to be heard. Please investigate and act appropriately. The current Pechanga chairman has mislead congress on land transfers and has lied to it's intended uses. Please take into account allotted Indians living on the reservation who have been denied rights that other citizens enjoy.

Pechanga abuses power at every turn. There is no way they will maintain the water rights for people who have lived there their whole lives but that Pechanga deems unworthy of membership. More on Pechanga's corruption here:

Please vote no on this settlement, until Pechanga does the right thing. They unlawfully disenrolled an entire extended family that has an allotment on the Pechanga Reservation. Pechanga enrollment committee hired a renowned anthropologist and ignored his findings.

Pechanga Chairman Mark Macarro has lied to Congress before, gaining land into trust, telling Congress that there were no development plans for the land because of cultural issues.

Well, now there is a golf course on that land, and Macarro's brother explained it as a "zoning change".

Macarro told the tribe that "all means all" when the tribe voted to halt all disenrollments, but he and his council majority terminated 25% of the tribe.

Do you believe him NOW, when he says that they will treat alottees fairly? Our family has had land there since the reservation was created. His council has many who have no land.

Stand up for what is right. And after you vote NO on this bill, continue to press Nick Rahall to hold an oversight hearing into the Indian Civil Rights Act, as Rep. Mike Thompson has requested.

Pechanga is lawless, they have no tribal court system and the current council has denied life long members due process. Pechanga was set aside for the use of the Temecula Indians, unfortunately the Pechanga band has denied access to the reservation to some Temecula Indians and holds land rights over the heads of allotted Indians. ICRA (Indian Civil Rights Act) fails to insure an enforceable clause for these acts. Vote no until Congress addresses this issue.

Pechanga has alotted Indians who have been stripped of their tribal affiliation by power hungry people. The courts have failed to hear the concerns, and says they feel there is unjust here, but do not have the authority to act. Congress has the authority and should protect these Indians from this heavy handed council that represents Pechanga. Vote no, and ask for the hearings on the ICRA (Indian civil rights act).

Chairman Macarro uses tribal assets, like their security force, to enforce his own personal agenda. He has blocked communication to support his unethical decisions. He has engaged in threating and malicious behavior, which is unprofessional for a chairman. The council is either absent or hushed. The Tribe should not be allowed to control the assets of individuals, particularly when the land is entrusted individually, not to the Tribe itself.

All Settlements are for the use and benefit of the Temecula Indians. Not a special subset of Indians calling themselves the Pechanga Band. The current chairman has over seen the denial of Allotted citizenship issues and access to areas on the Pechanga reservation. The current council should not be allowed to oversee this import trust responsibility. This bill clearly mentions Allotted Indians in it's language, and this bill should not pass until these allotted Indians rights are restored. Vote no

Pechanga Tribal Council disregarded all facts and without a semblence of due process, and with bias and malice, kicked out 100's of legitimate Pechanga members for their own (and family members) monetary benefit,leaving many of the kicked out members (including teminally ill, elderly, childen, single moms) without any healthcare. I am a descendant of Pechanga Indian allottee Paulina Hunter and we own allotment 62 on the Pechanga reservation and while we were disenrolled from the tribe in 2006 it is undisputed that our land patent as Temecula Indians is valid. The Pechanga government said that Pechanga is a subset of the Temecula Indians and while we maintain we are part of that subset, regardless we are still Temecula Indians. So the Pechanga tribe should not have sole jurisdiction over water rights and associated funds as the reservation was set aside for the Temecula tribe and village of Indians by Presidential executive orders in 1882 and 1893.

We were disenrolled from our tribe without due process of law and a part of our joint heritage, the Great Oak Ranch, was developed without our permission after the tribe promised to do no changes to it whatsoever.

The Pechanga water acts need to be defeated unless, apart from Pechanga jurisdition, our water rights are assured.

Below are exerpts from the congressional record April 17, 2002 of Pechanga chairman Mark Macarro promising not to change the Great Oak Ranch property

“Mr. Hayworth. Thank you Mr. Avery.

Chairman Macarro, does the Pechanga tribe have any plans for development of any kind on the Great Oak Ranch property?

Mr. Macarro. No, we don’t. As stated in our application to Interior/BIA, we stated or have designated there is no change of use in the property, and the intended use and purpose is to preserve and protect the resources that are there.

Mr Hayworth. Without objection, we would welcome that.

Just one follow-up, and for our purposes of the record, Mr. Chairman, does the tribe plan to use the Great Oak Ranch for gaming purposes or any purposes other than what you just outlined?

Mr Macarro. No, the tribe does not.”

Needless to say the track record of the Pechanga tribe regarding looking out for our rights and of being good stewards of our joint heritage, namely the Great Oak Ranch which Chairman Macarro described in his testimony to congress on April 17, 2002 as irreplacable resources of the Luiseno people, which we as Temecula Indians are still a part of, has not been very good.

How were our rights of due process denied? Among other violations, the tribal council under Mr. Macarro allowed close family members of witnesses against our family during our disenrollments to sit in judgement of our case which is a clear violation of the equal protection clause in the Band's own constitution and bylaws under Article V which forbids malice or prejudice of tribal members.

So how can they be counted on to deal fairly regarding our water rights?

So, again, they should not have sole jurisidition over our water resources and associated funds.

Great question. Federal recognition is “Temecula Band of Mission Indians” sometimes referred to as the Pechanga Band. Now a group of people are strong holding of land acquisitions and now water rights under the Pechanga Band. They are not recognizing the Temecula Indians anymore. How did this happen. Congress do not let the smooth talking chairman tell you any different. Allotted Indians of Pechanga should have the same rights as a subset of Indians on this reservation. We know you still federally recognize the Temecula Indians, please protect their rights.

I have good friends who are Pechanga and have been disenrolled and denied membership because they disagree politically with the Pechanga leadership. I urge a vote of "No" until the latter return to their senses. They should not be rewarded for bad behavior.

Now they are trying to get sole control of water rights to force them from their land. Representatives, Marc Maccaro as chair of the Temecula Band of Luiseño Mission Indians for the past decade and a half has lied to congress, overseen the removal of 25% of enrolled [adult] tribal members, banished individuals from the reservation who have a rightful place in the tribe, and spearheaded a Moratorium on enrollment for entire families that have allotted land on the reservation.

Maccaro has been documented in trivializing our plight by saying “if there was a cornfield instead of a casino these challenges would have taken the same path to the same conclusion” Documentary by KNBC news LA in a segment called “Without a Tribe” http://www.nbclosangeles.com/news/Pechanga_Membership_Battle_Los_Angeles.html

There are many stories of abuse in California's Indian Country, abuses that aren't being addressed.

ACLU won't look at it. Native American Rights Fund claims they don't do "Indian against Indian".

Politicians say the 'can't", when they mean they "Won't".

You CAN do something, you can make sure that tribes are NOT rewarded when they abuse their people.

Pechanga, Redding Rancheria, Picayune Rancheria, Enterprise Rancheria, Robinson Rancheria, just to name a FEW. Any wonder why Mike Thompson requested an oversight hearing on ICRA.

Exercise your outrage for moral rightness.

Do not give MORE power to the abuser.

The current Chairman of Pechanga said that bringing forth petitions is no way to run a government.

This would be like saying, don't bring forward a legislative bill.

Pechanga has violated many of it's own laws, and has no mechanism in place to assure fairness in these matters. Prior to two government elections the tribal council allowed two extended families to be removed from tribal rolls, thus tainting the democracy of Pechanga. These acts removed 25% of the voting membership. Vote no.

The US government has a legal trust obligation to protect property rights of individual Indian peple including those who have been disenrolled in violation of tribal and or federal law. The US Supreme court within the last few years already made it clear that lands alloted to individual indians could not simply be handed over to their tribal government even when the amounts of land are small. So, Congress should heed the Supreme court ruling. The federal government should protect the property rights of both the enrolled and disenrolled Pechanga people (as well as other disenrolled Indian people including freedmen of the 5 tribes); and such disenrolled persons who are property owners should certainly have a private right of action to appeal to the federal government (to the bia,federal courts, etc) in disputes over access and use of their own surface property, water,other mineral rights, etc. If such safeguards cannot be included in this bill, the bill should not be passed.

Interestingly, Rep. Joe Baca of Rialto, 60 miles from the Pechanga Reservation is a co-sponsor of the bill says that this bill is about JUSTICE. Please, Mr. Baca of Rialto, there needs to be justice for those who have had their civil rights violated:

•Stripped tribal members of their citizenship

•Denied voting rights to members

•Taken away rightful healthcare to seniors

•Blocked access to land on the reservation

•Denied members due process of law, including legal representation, even writing tools.

•Prohibition of practicing religion, including the right to pray at their ancestor's graves.

•Threatened others if they speak out

•Subjected some to ex post facto laws.

•Banishment from reservation at a whim.

•Failure to follow the tribal constitutions (Pechanga)

•Disallow burials where their ancestors were buried

Don't reward Pechanga until they do the right thing. You wanted to boycott AZ for POTENTIAL violations, yet will reward for ACTUAL violations

This is one deal that should not happen. Pechanga is now a tribe that will use this power to take leverage themselves over others that have no control over what happens on the Reservation. They have abused their power before and will continue until someone or something puts them in check.

Many will think this is just a membership dispute but this is action against injustice. Please do not think "we can't do anything". YES, you can. You can NOT reward Pechanga for the abuses they have done to their people.

Their actions are despicable. President McKinley gave our family land to Paulina Hunter, as head of household of TEMECULA Indians. Ask Chairman Macarro HOW MANY alottees he represents in the tribe and ask WHICH families they are. ASK how it is a person with NO Pechanga blood is on their council, yet proven Pechanga Temecula people aren't in the tribe. Ask why a family of Tosobol descendents were banished from their OWN LAND, or not allowed to use tribal roads that the US Government PAID FOR.

To members of congress, this is not an internal tribal matter as our water rights are not trumped by tribal sovereignty. So the tribe cannot say they get jurisdiction over our water and associated funds because we are joint heirs of the land that was set aside for the Temecula tribe and village of Indians in the 1800's.

As I said, the tribe claimed that being of the Temecula Band of Missions Indians was not good enough for tribal membership but this is not a membership issue and they (Pechanga) in effect reaffirmed us as Temeculas in claiming that they are a subset of the Temeculas.

Besides, the executive orders of 1882 and 1893 set aside the Pechanga reservation and the allotments for the Temecula tribe and village of Indians so we, as I said, are joint heirs who have just as much of a right to the water as they do.

Of course some people are given land by an elder who dies ,and they are not related to him ,so they have notthing coming,,,,,,but to the others that are indians that were given it by the U.S GOV,yes you are intitled to the money. (BUT AS I SAY) a elder can give land to someone and it does not make you PECHANGA INDIAN!!!!!!

Well, the water rights are not just for Pechanga Indians they are for the Temecula Indians which Pechanga claim they are a subset (a smaller group) from. So why can't it be us administering water for Pechanga rather than the other way around?

As we are the bigger group of Indians if in fact there are two seperate groups.

So I guess for now you (Pechangas)keep your membership in your private little country club but your sovereignty does not supercede our rights as land owning allotees with a U.S. patent as Temecula Indians signed by the President of the United States in 1893 as this is not a membership issue.

And where does it say the reservation was set aside for the Pechanga Band?

Nowhere, as it was set aside for the Temecula Band and village of Indians of which we are still a part of.

Congress please vote no!

I know many of these people who live at Pechanga. Many lived there before the Casino, had to bring water with them to the reservation. Vote no until their rights are protected.

Above is from the official allotment record so water rights are for all Temeculas not just Pechanga tribal members.

How does this bill benefit the allotted Indians residing on Pechanga? Who represents the allottees that have had their Native Rights stripped? Their voting rights stripped, health care stripped, ejected from tribal schools and forced to attend public schools off the Reservation. Advanced education removed. And you expect this tribe to act in the best interest of these same Original Pechanga Temecula Indian Allottees?

This is one deal that should not happen. Pechanga is now a tribe that will use this power to leverage themselves over others that have no control over what happens on the Reservation. They have abused their power before and will continue until someone or something puts them in check. VOTE NO.

We had a very small group (although one that had wormed there way into power) question our right to be part of the Tribe (after we had brought up questionable activities about enrollment issues).

We were brought before these very same people who had brought the allegations against us. These were the people who were to decide our membership.

How would you feel if the very same people who had accused you were to be those who would sit in judgment over you? This is what happened to us.

Now you would give water rights to these very same people? Oh yeah, I am sure they would treat us justly.

Vote NO on this issue until something can be done to provide protection to the rights of those Indians who still live on the reservation and have been disenrolled.

Not Ironic that the Justice will revolve around water. Name place for spring of life. Pechanga was set aside by Executive order and put in trust for Temecula Pechanga people. Vote no! Bring the Temecula Pechanga families back to thier homes.
